Umm... "Company owns 6 patents in China". "A cellular phone battery pole plate; polymer lithium-ion battery and its production method; large capacity polymer lithium-ion battery and its production method; an ultra-thin polymer lithium-ion battery for a miner's lamp and its production method; walkie-talkie lithium-ion battery and its production method and mobile phone battery and its production method". That's some intellectual property!

Not just batteries for miner's lamps "denkab".Founded in September 2002, Advanced Battery Technologies develops, manufactures, and distributes PLI batteries using lithium cobalt oxide anodes to overcome many of the shortcomings associated with other types of rechargeable batteries. Look, for me the fact that they chose to not obtain patents in US means this IP is not really patentable (and after you've obtained patents abroad, you can not patent in US, as information is considered to be out in the open). I may be wrong, of course, but then I don't put real money on this bet.

This is from their most recent 10K:"ZQ Power-Tech owns seven Chinese patents, which are patents on:- A cellular phone battery pole plate.- A polymer lithium-ion battery and its production method.- A large capacity polymer lithium-ion battery and its production method.- An ultra-thin polymer lithium-ion battery for a miner's lamp and its production method.- A walkie-talkie lithium-ion battery and its production method.- A mobile phone battery and its production method.- A nano material lithium ion battery and its production process.We also hold one US patent (Patent No. 6,994,737 B2) which covers a high capacitypolymeric lithium-ion cell and its production method."

And from my knowledge of patents, if I see an idea for a product in China I can patent it here in the U.S. if it doesn't exist in the U.S. It's called a universal patent which you can apply country by country.

This could possibly be a very good point. My understanding of the Chinese market is that there are so many companies that lawlessly produce patented products, the way to keep others from encroaching on you IP is to keep it a Trade Secret, such as Coco~Cola has done. Given the market of emerging technologies in China and around the globe, as long as patents which are published for the world to see, trade secrets will remain more important.The question is: do they have secret designs, components and processes & how good are they? Does the company consistently allocate the right amount of funding to R&D?Also, which countries are the current patents registered in?Happy Speculating!

What that means in English is that you can't obtain a patent if someone ELSE already has a patent in another country.

I agree, language is confusing. But is that all? How about the clause where a product was being sold in US for extended period of time? What of the clause about information on invention being published in mass media? I'll be very glad if ABAT had no problems patenting in US. But until they did, I have room for doubt on novelty of this invention."If the invention has been described in a printed publication anywhere, or has been in public use or on sale in this country more than one year before the date on which an application for patent is filed in this country, a patent cannot be obtained."One cannot start selling the product in US, and obtain a patent later on, that's how I read it.I don't have time to search USPTO database, it's search feature is not as good as Google's, but still I doubt that Fujis, NECs and others of this world did not figure out that they can use film to store active substance in those Li-ion batteries.

who cares about the patent? if i had a company i would invest the time and money in patenting my product to protect myself from chinese who would copy my product and sell it here in the u.s.but this company is already a chinese company, they can't copy themselves!!!!plus if a new player comes in who would copy their products they are already late in the game/market, they have to develop the infrastructure and customer base that this company already has.in short, what the hell, i invest for hell of it. i bought 55 shares today
