After 405 days (14+ months) of idiotic delay and posturing, I have to conclude that the FCC is on the take to kill or disrupt this deal.Not since Katrina has a government agency been so irresponsible in their duties. Nice Job Kevin "Brownie" Martin.Martin should be turned out with the trash if he can't make a decision in a reasonable time period. After three missed dates/promises and nearing 15 months, his department's performance is an embarrassment to thinking people.

Update in incompetence.....Now it's 425 days ..... how many FCC committee members can you buy for $1000.00? Thank God for the weak dollar..... their on sale!

I am long SIRI and have been for some time. Although the behavior of the FCC is disappointing I am not entirely sure that not having the FCC on board is bad.If the FCC continues to slow step the process, which is likely, I look forward to SIRI being a target of RIMM, Apple, or others. I think there may be many other great suiters for SIRI. A device maker could potentially be a great fit as they could benefit greatly by the sale of content, etc.

I've had to come to the conclusion that the decision has already been made by the FCC and Mr. Martin, it was made shortly after the "Whole Foods" decision and court action. Martin realized that a negative decision had a high probability of being overturned, a positive decision would not serve NAB. The best route to take, stall until the end of his term. Next administration will do the same. This action aids NAB, weakens both SIRI and XMSR. At some point SIRI or XMSR will have to decide to abandon their merger attempt, both being in a much weakened state or one or the other out of business. For Martin and the NAB, mission accomplished.

Martin just ( 5/23) stated that the FCC should before the end of the second quarter.In 2007 he said the FCC should rule by year's end.In February he said the FCC should be able to issue a ruling in Q1.At what point in time does the Bush Administration fire this joker? He is so obviously incompetent and hellbent on trying to save his job. So sad. So pathetic. So desperate.
